Hi, thought I'd begin by saying that I'm 18 year old, and that this incident occurred in Portage County, specifically, the township of Franklin.
I was pulled over by a State Trooper on a residential street (possibly a state route, but doubtful). The officer informed me that I had been speeding, and I debated him because I had passed him in the opposite lane of traffic, and observed him following someone else closely over the hill as I passed. The officer returned to my car and issued me a written warning for the speed. His backup arrived just then, and he told me he would return in a second. After about 10 minutes of talking to the other troopers, he returned and asked me to step out of the vehicle. I sat down in the front seat of his cruiser and he asked if I had anything illegal in the car, or any weapons on me. To which I lied, and said no. He had a dog sweep around my car (my passenger was still inside the vehicle) and after a few minutes, he returned telling me the dog had found nothing. He than told me that he would like to search the car, and that I could tell him to stop at any time. I, being frightened and naive to the law, consented (waivering my rights) and the officer returned with a small stem he said he recovered from my ashtray, which was probable cause. He again returned with a small glass pipe which he found underneath my seat. He confiscated the pipe, told me that I had been very cooperative with him, and that he would only issue me a citation instead of taking me to jail.
So my questions are:
1. Will my driving privileges get suspended for 6 months as is typical in Ohio?
2. How should I plea? And is a not guilty plea with hopes of plea bargaining a good idea?
3. Does Ohio have a Section 7411 like Michigan or am I out of luck?
I should also mention that this is my first criminal offense since I was a juvenile, and my record has been sealed since that time. I have never had a drug offense before either. Only traffic violations, which I seem to get on a regular basis.
