    Default Registration As A Sex Offender Due To Mistaken Release Date

    In 1993 they are given 4yrs probation for atempted sexual assault. In 1996 the probation is revoked. because they picked up a white collar money case. they were sentanced 6 months jail time. The time remaining on the probation. The State of Texas held them 6 months more by a paperwork mistake. Do they have a case against the state for holding them past their release date? and causing them to have to register as a sex offender, when they only had to register for the 4yrs.that they were sentanced? They would have been out ,before the new law in 1997 started.That law said that all sex offenders would either have too register for 10yrs or a life time. Is this a case or is it to late to do anything now?

    When you violate probation, you get resentenced and you can get additional sanctions and jail or prison time. This "extra" time you spent in jail - was it eventually made part of a "time served" sentence on either the sex offense or the "money" case?

    The fact that you haven't taken any action on your case for a decade doesn't help you, even if you once had a potential claim against the state for holding you beyond the end of your sentence. Consult a criminal defense lawyer to see if there is anything you can do about the registration.
