My question involves labor and employment law for the state of: New York

My employer provides health insurance coverage for me and my family. What I heard is that I can include my child up to 21 y.o., or up to 26 if he/she is in college. My daughter is 22 and she is out of college and does not work. Actually, she does some work, but that is part-time, volunteering job at a local public library. Obviously, they don't provide her with health insurance.

My question is can I include my daughter in my employer-sponsored health insurance policy? This year she is still in my family policy because she was in college, but what about the coming year? I have not asked our HR yet, because re-enrollment period has not started yet, but I want to be prepared.

If not, what other options we have? We are not qualified for Obama-care because our combined family income was 116k for last year and will be about the same for this year.

To pay for her insurance out of our pocket is impossible, we cannot afford another 6k, and my premium at employer’s plan is the same regardless of number of children (we also have younger son).

Thanks
