    Exclamation Kidnapping Report Where the Victim Seems to Go Voluntarily With the Defendant

    My question involves criminal law for the state of: Illinois

    My mother made me file an abduction police report, but I'm scared that the police officers will see the security footage of the parking lot and assume that I voluntarily got in this man's car (I walked over to it, he grabbed my arm and demanded I get in the car, so I opened the door and did). If they think I'm lying, will they take me to court?

    If the police think you lied in your police report, they might do nothing, they might drop the investigation, and/or they might arrest you. Needless to say, no one on this or any other internet message board can intelligently predict what some unknown police officer(s) in Illinois might think or do upon viewing video footage that we haven't seen.

    It’s really pretty simple:

    either you were abducted or you weren’t.

    Filing a false police report is a crime. You can actually go to jail for it

    if you were not abducted, the man involved would have a claim against you for defamation.


    If you were abducted, then you don’t have anything to worry about.

    If what you describe is what happened, then it's up to the state to determine if there was a crime (abduction or whatever) committed or not.
    Your statement of what happened is neither going to send you to jail nor get a defamation claim. If the staet determines that what happened wasn't a crime, that's the end of it.

    Now if you said something that wasn't true, then there might be cause for concern.
    How old are you?


    Oh, and as you stated, that sounds very much like an abduction. He doesn't actually have to force you in the car, his threats to you are sufficient if they caused you to get in. It certainly sounds like at least assault.

    IF this was an abduction, then the op is safe from prosecution for filing a false police report

    the problem I have is; why is the mother forcing the op to file a report stating it involves abduction? There is something odd obviously about the situation. It may be the mother has an axe to grind with the abductor and wants to turn a nothing into a something. If that is the case and the op lies on the statement, yes, they can be prosecuted and end up in jail. Its becoming more commonplace that a person making a false report, especially involving a serious crime, is being prosecuted for the false statements.


    I write that as precautionary due to the odd statements made by the op. It’s one of those situations where you get the feeling the op is not being open enough to make any real determination. Due to that, they should understand the consequences of filing a false police report just in case it is what is happening.

    To the op: I am speaking to actual false statements; lies. If you are truthful in your statement, there will be no repercussions from the courts or the other party.
