    Question Shoplifting and Kohls

    My SIL was with a group of girls who were caught shoplifting. She had no merchandise on her, her friends did. She signs a paper stating she will never return to their stores again, and is told that she will receive something in the mail. She gets a letter stating she needed to return merchandise (mind u when the police came she had none to return) or pay $200 in fines or call and make arrangements and no further criminal action would be taken against her. She called the # on the paper for Kohls and made arrangements, she sent in her first payment already....and now today we found out they have issued a warrant. Obliviously its possible, but how or why would they go back and do this after she already made the arrangements with them, why would they still turn her in and request her arrest n a warrant for her, after they are already receiving the amt. requested from her? Thanks for any help or advice for her.

    A: The arrangement made with the victims was a civil matter. The cops can still go after criminals.

    but they said its cuz Kohls is pressing the issue, so why would Kohls do that if Kohls already made arrangements for it?

    Let me explain it this way: the deal you and Kohls made has nothing to do with criminal charges.

    The criminal charges are filed by the government and the government does not charge whether Kohls is pressing the issue or not pressing the issue. It is totally irrelevant.

    In other words, when you commit a crime, you can expect to get in trouble even if the victim does not want you to get in trouble.

    Does she have anything stating the monies were in exchange for pressing charges? Or does she have anything stating they are not pressing charges? If answer is no then its pretty much as you were told. the monies were Civil the warrant is on a criminal matter.

    Civil Demand and warrant are two seperate issues you cannot gauge one by the other

    Unless the CD letters are coming from same Lw firm you cannot use one to figure when yours will come. You can contact store ask for number of Civil Demand company they use and call them
