    Post What is the Legal Effect of a Notice to Cease from a Landlord

    My question involves landlord-tenant law in the State of: New Jersey

    I have received a notice to cease in the form of warning from my property management for not permitting maintenance worker in my apartment during my absence to do the necessary repair work. I asked him to come to my house for repair when i am present but he wanted to access my apartment during my absence. Long story short the repair work was done next day when i was present but after a month i received a "NOTCE TO CEASE" warning me to cease (stop) (refusal/denying access to apartment). I have a electronic proof that repair work was completed on next date. May i know if this letter is simply the warning ? or does this mean that landlord is going to evict me ? Am i required to respond this letter in writing stating that access to apartment was permitted next day.

    No, you aren't getting evicted.

    But I do suggest that you respond in writing that access was permitted and that you understand that maintenance and service may be performed in your absence with reasonable notice.

    Sure i am going to respond the letter along with the copy proof of work order that was created by me stating (Granting permission to enter my apartment) and also the work order that was completed by Super stating (Permission to my apartment was granted).

    I think that the letter is indicating that you should accept that the maintenance people may occasionally need to enter your unit when you are not home, to perform necessary maintenance.

    You really do not have the right to insist that they only enter when you are present. You have the right to insist upon receiving proper notice so that you may cancel any plans that you have so that you can be present, but not to insist that they must wait until its convenient for you to be present.

    If you're confused about your landlord's intentions, asking anonymous strangers who don't know your landlord seems a pretty poor way to find out -- as opposed to asking the landlord. Don'tcha think?
