    Default Guardianship Law

    My question involves a person located in the state of: Arkansas.

    How do I obtain the right papers to file to vacate a guardianship? I was blessed with twins in July and the mother consented to a temporary guardianship thirty min after birth but in the petition the lawyer put there was no father so I knew NOTHING ABOIT THE GUARDIANSHIP till it was over. I did the ACKNOWLEDGEMENTS OF Paternity and I am on the birth certificates? I can not afford a lawyer but I want to get this guardianship over turned and get my babies! Where can I get the right paperwork to file by myself

    Who obtained guardianship? How old are the children now.

    He said that they were born in July, so I am guessing that would make them about two months old. I too would like to know who has guardianship.

    OP, look on your local court's website to see if there are any forms available to vacate a guardianship. If there are not, you will have to write your own motion, from scratch. Which is why you probably need an attorney.

    I have not gotten NO help from my local courts. Their automatic response is they don’t give legal advice and only forms they will provide are cover sheets. Not even instructions to fill it out. I can not even find a SAMPLE motion or petition to vacate or terminate! Another question I have is if her lawyer is being paid by the state to represent her in a dhs case how can he except money from her cousin $600 to file a petition for guardianship AGAINST HER using her dhs case against her in the petition?

    Right. That's how it works. Courts are not legal clinics. You'll need to retain counsel if you can't figure this out.
