    Question Will The Father Get In Trouble?

    Hi, I am 18 and I am about 8 months pregnant. I am in the state of Florida! The father is a guy who is over 27 years old. I got pregnant before I turned 18. My birthday is in November and I got pregnant in September of 2006. Will he get in trouble if I put him as the father of the baby? He is the father and we are together and we plan to get married down the line. I am really freaking out as to if I should put him as the father or not. Please help..... At the time I got pregnant I was already out of my mom's house and I was dropped out of school!!! So please please let me know If he would or not!

    Unlawful sexual activity with certain minors if someone age 24 or older engages in sexual activity with someone age 16 or 17.
    Up to 15 years in prison

    i seriously doubt that criminal charges will be instituted by the DA because you list him on the birth certificate. they don't have time to go through every birth certificate looking for discrepancies like that.

    Of course not...But one of the HUNDREDS of mandated reporters at the hospital very well could call the police or CPS...

    As you're not married, you can't "put him down" as the father. He will only be identified as the child's father on the birth certificate if you and he complete an affidavit of paternity, or he is adjudicated to be the child's father through a paternity action. See Florida Statutes § 382.013, here.

    how would i go about doing that? What if we were to get married before I deliver? Will he still get in trouble for me getting pregnant before I turned 18?

    You would do that by filling out an affidavit of paternity at the hospital or after you leave. Marriage doesn't erase criminal activity. Ask for a copy of the affidavit form at the hospital and see if it requires you to list the father's age.
