    Default Ticketed for Passing a School Bus Based on the Driver's Report to the Police

    My question involves a traffic ticket from the state of: Ohio

    My 16 year old son came to stop behind a school bus. The bus lights were flashing. He waited 30 seconds. When nothing happened he pulled around the school bus and saw the bus driver standing in the yard waiting for the child to come out of the house. No other kids were visible. He didn't know what to do so he kept going as did 3 other cars behind him. The bus driver got his license plate and reported it to the local police. He was cited for "passing a stopped school bus" - as written on ticket.

    There is all kinds of information on the internet - it's hard to keep it all straight. We just want to know what to expect when we go to juvenile court. My son has had his license for 3 months with no other violations.

    No it isn't. Not when you ignore all the information on the "internet" and read the statute:

    4511.75 Stopping for stopped school bus.
    (A) The driver of a vehicle, streetcar, or trackless trolley upon meeting or overtaking from either direction any school bus stopped for the purpose of receiving or discharging any school child, person attending programs offered by community boards of mental health and county boards of developmental disabilities, or child attending a program offered by a head start agency, shall stop at least ten feet from the front or rear of the school bus and shall not proceed until such school bus resumes motion, or until signaled by the school bus driver to proceed.

    As long as the lights were flashing he stays put.

    Wouldn't surprise me if Ohio school buses are equipped with video cameras front and back that are activated when the flashing lights go on.

    And when the driver's boss says go to court, the driver will go.

    Notice that all that is needed is the license plate from the vehicle and a general description of the driver to begin the investgation. Pretty much all school districts have standardized forms that bus driver's fill out the contain this information. They are then forwarded onto the appropriate police departments.

    Also notice that it requires the police to establish who the operator of the vehicle was at the time of the violation. If they can not establish who was operating the vehicle then they can only issue a WARNING to the registered owner of the vehicle.

    If it was something along those lines then the bus driver is not needed to testify and no photo lines up will be shown as he admitted the violation to the officer himself. The fact that other people violated the law will not help him.

    As far as penalties go it is up to a five hundred dollar fine and possibly a class 7 suspension (Up to 1 year). A lot will depend on what court you are going to, what the mood of the judge is, and sometimes how serious the other cases that go before you are. I've seen everything from just court costs and waived fines to the full suspensions depending on prior records and how respectful and sincere his apology is.
