    Default Does a Notice to Quit Need to Be Served on Tenant Who is in Jail

    My question involves landlord-tenant law in the State of: Pennsylvania
    PA law requires posting the 10 Day Notice to Quit for Non-Payment of Rent on tenant's door. Notice to Quit was also mailed to tenant but I assume it has not been received since incarceration. Does the law require the same Notice to Quit be served to a tenant by a constable to the jail where the tenant is incarcerated?

    You can serve it merely by posting it on the leased premises:

    (f) The notice provided for in this section may be served personally on the tenant, or by leaving the same at the principal building upon the premises, or by posting the same conspicuously on the leased premises.

    Note the words "or" in the statute. You don't have to personally serve it if you posted it on the leased unit. Mailing it isn't required nor does it satisfy anything.

    Having been a landlord myself for many years, I strongly suggest that you have it served personally on him jail and get written confirmation that it was done.

    If he denies receipt when you file for eviction, the delay could cost you quite a bit of money if the eviction is dismissed and you have to start all over with a fresh notice.

    Up to you but, if it was me, I would get it served on him in jail.

    Thank you for your responses. Through research I had found that posting the Notice to Quit on the premises was all that was needed but persons that I had asked would not agree definitively. So, today I did send

    a mailing return receipt requested. Afterwards, I found out that at this particular jail it takes @ 2 weeks for the inmates to receive their mail since not only is each mailpiece inspected but each stamp is removed

    to check for hidden drugs! So, the 10-day Notice to Quit is not even seen by the tenant for at least 14 days.
