    Default Can a Child Get Emancipated to Avoid Living With Her Mother's Friends

    My question involves juvenile law in the State of:

    I know a girl who is in a difficult situation. Her mother is homeless and currently living with some friends. The friends do not have room at the moment for the mothers children so they live with a new acquaintance. Mother wants her children to move in with her and her friends soon but her 16 yr old daughter does not feel safe there with moms fiends. (Their 17 yr old boy has an unhealthy obsession with her). Her mother knows that her daughter feels unsafe but wants her to live there anyway. Mom can't hold a job, has no home and no driver's licenses... I think the 16 yr old daughter is just tired of living in and out of shelters and friends houses. Daughter is currently geting her own liscense and job to be able to support herself.
    Does this seem like a situation where Emancipation might be a possibility?

    We ask for your state for a reason. Not all states allow minors to be emancipated at all and those that do have different requirements. Without knowing what state she is in no one here can do anything but guess.

    You did not tell us the state that is involved, but unless your friend has actual means of supporting herself it is unlikely that she could get emancipated. In some states it will also be necessary for her to be living independently and supporting herself before she can qualify for emancipation. Plans aren't sufficient.

    She lives in Indiana. I have read that sometimes the Child must live independently first but Can she live independently at 16? Wouldnt she be considered a runaway?

    If her parents give her permission to live independently, she may. If they do not give her permission to live independently, she may not. If they will not give her permission and she must be living independently to be emancipated, then she cannot be emancipated. It's as simple as that. Emancipation is not a right; it is a privilege.

    In any case, Indiana requires that she be able to prove to the satisfaction of a judge, who will not be easily satisfied, that she is able to support herself with no assistance from her parents and no assistance from the government. The judge will also have to agree that the reasons for wanting emancipation are adequate.
