    Question Interstate Enforcement of Florida Child Support Order

    Hello - I have a child support & alimony order registered in Florida, but my ex-husband, who lives in Tennessee, is over $20,000 in arrears. (He could pay it, but he is doing this to make me miserable.)

    My ex sued me in Florida to get the support amount reduced or abated, but he failed & the original order stayed in place. (He is threatening an appeal, though.) Also, the Florida court held him in contempt. He paid the purge that the court ordered him to pay, but it was less than $3000. He has tried to move all of his assets into his girlfriend's name. What can I do to enforce the arrearage? This has been going on for 18 months.
    I can't afford to hire a lawyer in TN.

    Go talk to the local United States Attorney.

    There is a federal child support criminal statute.

    Try getting the child support agency in your state to initiate a UIFSA action in Tennessee, through the county prosecutor for the county where your ex-husband presently resides.

    This is the least expensive approach, but the DOR CSE moves slowly. To find the nearest CSE office call 1-800-622-5437.

    Not all crimes against children involve physical violence. Some, such as the failure to pay child support, effect the economic well-being of the child. The Child Support Recovery Act (CSRA) of 1992, makes the willful failure to pay a past due support obligation with respect to a child residing in another state a federal misdemeanor offense. The Deadbeat Parents Punishment Act (DDPA) of 1998, amended the CSRA of 1992. The DPPA established felony violations for traveling in interstate or foreign commerce to evade a child support obligation or for failing to pay a child support obligation which is greater than $10,000 or has remained unpaid for a period longer than two years. Previously, child support cases involved only a misdemeanor violation with a penalty of less than one year imprisonment.

    The U.S. Attorney's Office in Florida told me that they require a referral from the FL Department of Revenue, and that frankly, it also takes some political push to get that referral to happen. They actually told me that if the deadbeat dad is determined to get away with it, he probably can.

    Your tax dollars at work. I don't think that was the response Congress intended when they passed the Deadbeat Parents Punishment Act.

    So, write your congressman.
    And that's not a wise crack.
    Really, write to him.
    If that doesn't work, make an appointment with him.
    If that doesn't work, find a group for people in your situation, get some wood,poster board, and magic markers, and THEN visit him.
    Yeah, the laws suck, but that doesn't mean you have to give up.

    As I advised you earlier, call the Dept. of Revenue at the number I gave you to find out where the correct office is located. Then call the court clerk's office to get an "arrearage affidavit" and then give that to the DOR and demand that they do thier job. It does NOT take any political push to get it done, it does take a CP's push though. When a CP pushes and pushes, the DOR WILL refer it for enforcement and a contempt motion, especially when thier has already been a finding of contempt in the case.
