    Default Can You Get Emancipated at 17 After Graduating from High School

    My question involves juvenile law in the State of: Louisiana

    So, I just turned 16. I'm graduating next August - early. I'll be 17 by then, nearly a month prior. But, I will not have a reason to live with my mother anymore because I wish to take a year break between high school and college.

    What I want to know is if I can get emancipated with just my father's approval or does it have to be both my mother and my father? Because my friends have told me if I wanted to, I could live at their house. I just don't want to be forced to return home - me and my mom don't have the best of a relationship: she found out that I lost my virginity recently and has taken everything from me. I can't hang out with my friends, my phone got taken away (I have a question about that as well), and all I can really do is work and school. So, I'd like to get out of the house. I know this seems childish and y'all may say, "Ah, sucks for you. My parents did the same thing and it shaped me to be such a better person.": I can work and make my own living and I have housing already set up. I don't need my parents on my back as much as they are and I'd like to go off on my own. So, answer me this: if I graduate high school when I am 17, can I officially move out without fear of the law taking me back? Do I need both parents or just my father to get me emancipated?

    Oh yeah the phone question: if I buy my own phone with the money from my job, like I pay for the plan and the physical phone with no help from my parents, can they take it away? The one she did take away was bought by her but I can buy my own and pay for that if need be. I just dont want to have it taken again.

    Taking things away from poorly behaved girls is called "good parenting." You'll not get anything out of that. Graduating high school means squat.
    In your state, absent parental consent as well as good cause (which you appear to have neither), you're not getting emancipated.

    No matter what you do, if your parents say no phone, no phone.

    When you turn 18, then you can face the harsh reality of going out on your own.

    Who is going to be supporting you ? You won't be making enough to support yourself ? Do you plan on going to college ? If you apply for a PELL Grant. You will have to have information from your parents and their signature.

    Not getting along with people is part of life. You need to learn how to make the best of the situation you got yourself into. I hope some type of birth control was used. Flyingron is correct. Being punished when you make poor, bad, irresponsible decisions is good parenting.

    Louisiana recognizes three forms of emancipation: judicial emancipation, emancipation by marriage, and limited emancipation by authentic act. You're not married.

    For judicial emancipation, a court must approve emancipation, and either or both of your parents may oppose your petition. Limited emancipation by authentic act allows your parents to issue a document granting you decision-making authority as described in the document, but does not otherwise remove the effects of minority.
