    Unhappy Assault of a Teacher and Disrupting School Activity

    Recently my husband was made aware of a charge from oct 2005. he was 18 and in high school. after school while walking out to the parking lot with his twin brother. His brother was attacked by another student. My husband pulled the two apart and took his brother to the car and they left. seems simple enough but someone filed charges against my husband. a year and a half passes. he is pulled over 3 times for minor traffic violations and ticketed in the time period and no arrests are made... no conversations about warrants. we are involved in a car accident where our suv flips on the highway..still no warrant or charges are brought up after veiwing his record. then my husband is driving home from work and his wheel falls off, the officer that is there to cite the incident tells him that there is a warrant out for his arrest for assulting a teacher/ disrupting school activity. he has no idea what these charges are for or when they are from. finally we are able to access the records and we discover that the charge is from 2005 the incident after school is the only event that we could think that may lead to these charges. Now the questions are: Is there any way we can get these charges dismissed? My husband and i have a a good hardworking life and a 8 month old daughter. we both attend school and work full time. we want this taken care of. If we can not get the charges dimissed is there anyway this will not affect his future employment (he recently had an interview at our college for a security position and was denied because of the record, he would have for sure been hired had it not been for the charge) Do we have to post bond? If the bond is 500 dollars, how much will we have to pay? Should we use a public defender or buckle our belts and hire someone? Lastly, Are there any other things we should be aware of in our situation? Thank you for your time.

    also the warrant was issued the same day that the charges were filled could the warrant be a warrant to keep the peace? why would the warrant date be the same day that the charges were filled?

    Your husband should consult a criminal defense lawyer about contacting the prosecutor and trying to negotiate a resolution to the charge. He would have to turn himself in and make a petition with the court to get a court-appointed lawyer, and he's probably better off trying to work out a deal before he turns himself in on the charge. Any job which performs a criminal background check could potentially discover the outstanding charge and warrant.
