    Default Can Landlords Run Credit Reports on Former Tenants

    My question involves collection proceedings in the State of: NY

    We are a NYC landlord and aggressively pursue money judgments against former tenants that owe rent arrears and/or for damages to the unit. We do our best to enforce the judgment.

    We are the original judgment creditor. Are we permitted by law to run credit checks on these judgment debtors (former tenants)? Would like to see their current employment information, if available.

    Yes.

    See the Fair Credit Reporting Act Section 604 (a) (3) (A):

    New York's own FCRA has similar wording:

    Both allow obtaining a credit report for the purpose of collecting on the account.
