    Default Mother and Stepmother Filed a Counter-Petition for Paternity

    My question involves a child custody case from the State of: new York

    My original petition said that Im the father of the newborn and mother and I were together up to the end of 2017. And I also claimed she was not married at the time the child was born. So in the new petition stepmother is included as the child was born under marriage.

    How did they even accepted this?

    If you're stating that you got the facts wrong, and your ex- was married at the time of the child's birth, that would explain why she responded that she was married at that time.

    If you got the facts wrong and your complaint cannot succeed unless you amend your complaint, you can amend your complaint. If the facts you got wrong aren't relevant to your complaint, then they're not relevant to your complaint. Nobody here has read your complaint. As Mtxpro123 says, talk to your lawyer.

    She filed a motion saying that my petition is a fraud.
