    Default Divorce and Alienation of Affection

    My question involves a marriage in the state of: NC

    I caught my husband having an affair with a married woman. The affair started in approximately December 2017 and my PI caught them on surveillance video in May 2018. The married womanís husband also hired a PI and he too caught our spouses affair earlier than I, but he has shared his PIís reports with me and my attorney.

    I have filed a complaint against my husband for post separation support, alimony and my attorney fees. I am waiting for the married woman and her husband to finalize their divorce, hopefully this week, and then my attorney will serve my husbandís lover with my complaint against her for alienation of affection.

    My husband works for a family owned business and the son of the business, also half owner of the business has known about, and covered up, my husbandís affair. The affair has happened during working hours in cheap hotels rooms for 2-3 hour intervals. The companyís fleet of trucks is monitored heavily by the mother of the company, as she has GPS tracking devices on the fleet. The employees are not allowed to use the work trucks for personal use, but last time I checked an affair on company time and a company work truck used to get to a location for personal pleasure is considered personal use of a work vehicle.

    Back in March 2018 my husband and the son of the business went to a 3 day HVAC trade show 3 hours away from home. They stayed in a two bedroom suit where the married woman joined my husband on the second day at the hotel and spent the night in the same room/suit with my husband. My husbandís employer has aided and abetted in coverungbthis affair for my husband.

    Do I have a leg to stand on in filing a complaint against my husbandís employer for alienation of affection by having knowledge of and for aiding in the cover up of my husbandís affair?

    My husbandís employer is also established in NC as well.

    Even if we assume that he knew about the affair, your husband's employer had no duty to try to stop the affair or tell you about it. There is nothing wrong with putting up co-workers in two-bedroom hotel suites where each has a private bedroom.

    You want your husband to pay alimony, your attorney fees, and post separation support. In order to do that, he needs a good job. If you mess with that job by trying to sue the owner, no matter how frivolous that suit ends up being, what do you think that will do to your husband's good job?

    Don't mess with the employer. Don't cut off your nose to spite your face.

    Bluntly, no. They are not your husband's keeper and they owe no duty of fidelity to you. Your husband is a big boy and makes his own decisions. It's cheaper for an employer to pay for one two bedroom suite than for two individual rooms; that's just good economics. That your husband doesn't have enough common sense to keep his zipper zipped is his decision and has nothing to do with the employer. Your beef (and you do have one) is with him, not with them.
