    Default Name Change in Texas

    I was thinking about changing my son's last name to mine. We currently live in Texas where we are residents and have a child support in place, however, my child was born in California and CA is where I received physical custody of my child. The father still lives in CA, but rarely sees his son or even talks to him. I actually did some research and he's only talked to him under an hour since September. I don't think he really cares, he says he does but never makes the effort. I doubt he'd willingly let me change his last name, but he's really not in his life and I'd like my son to have the same last name as me, rather than some dead beat, who never contacts him! With his dad it's all about control. Would it be worth it to try to get the name change, and would he have to come to TX to fight it, since this is where we reside? When I ask would it be worth, to me it's worth the fight, but is it a good enough reason in the eyes of the court? Yes, he pays child support, but really that's all he does?

    How old is your child?

    You can file and ask the court to order a name change, but you'll need to prove that it's in your child's best interests. Age will be a factor. Since the custody order is in CA and the father lives in CA I *believe* that you would have to file with the CA court, but I'm not 100% certain on that. The best way to find out is to get a short consult with a family law attorney who should know more about which state would have jurisdiction over a name change petition.
