    Default Balloon Promissory Note

    I have a $30,000.00+10%interest annually Balloon Payment Promissary Note from my exhusband signed Jan. 9,2004, due Jan. 8, 2007. How can I collect this without having to hire an Attorney? Can I file a lein on his house? Can he claim money he's givin me during the last 3 years as payment even though it was not designated as such? If neccesary to hire legal representation what is a reasonable fee for this service? How long should it take? I live in California.

    Does the promissory note state that the bad guy will pay for your lawyer's fees if you have to sue the bad guy?

    In any event, for $30K, you need to hire a lawyer.

    yes. Borrower must pay all costsof collection , including reasonable attorney's fees whether a lawsuit is commenced.
