    Question Lender Did Not Pick Up Car After Bankruptcy

    Hello all,

    I have a few questions, i filed for bankruptcy a couple of years ago and i agreed to surrender my vehicle (which since then had a bad transmission and is not running still) the weird thing is that after my bankruptcy was discharged they never contact me to pick up the car, i still have the car and no body seems to care about it after 2 years, my questions are as follow;

    1- can i re-register the car if i fix it?
    2- can they still repo the car even if is not working, and if they wont repo it what can i do?
    3- should i call them and ask them about this? (im afraid because i thing they might try to do something against me even though my lawyer said that after bankruptcy the could't do anything against me)

    the car is a 1992 jeep grand cherokee

    any advice is greatly appreciated, location is California.

    The car belongs to the lender. You should contact them. See if they will give it to you for $100.

    I have seen similar threads here, all of which have no conclusion despite being quite old. What ever happened with the car?? I feel that despite defaulting, no one should be allowed to abandon a vehichle on your property that you dont have a title to. In Illinois its illegal for me to abandon my car somewhere so why can a bank do it. So why should you pay them anything for the title? I see lots of suggestions and accusations, has anyone actually ever resolved this kind of problem????

    We have a similar problem. We files Chpt and had all our debts discharged in January of this year. (2010) We contacted the lender - bank through our lawyer and on our own several times stating that we were willfully surrendering the vehicle. They have us on record as willfully surrendering. Its now June and we have not heard from them. We were thinking of going to the MVA and declaring the vehicle as abandoned. We already turned in the plates and notified the MVA that we were surrendering it. Any thoughts on the legality of claiming it as abandoned? In VA (where we live) a vehicle is considered abandoned after sitting for 48 hours on your property against your wishes.....
