My wife and I do have another car, that she uses to go to work (2 - 3 days per week), to go shopping, and transport our children. I don't remember if that other car is in my name or her name. Having one car is not feasible. There is no public transport where we live.

So when I go file, and the court sees $5k in my bank account, I can just tell them I have it reserved to buy a car, and they will not force me to use it to repay my creditors?
I would strongly recommend that you get a consult with a bankruptcy attorney BEFORE you actually file for bankruptcy. I firmly believe that you are going to find that you need to buy the car BEFORE you file.
