    Default Sealed Felony Arrest and Effect on Teaching or Law School

    I was arrested over ten years ago (age 18) on two separate felonies (criminal mischief and a credit card dispute).I have checked my Federal FBI record, and it states no record. However, I have recently applied and have been accepted to law school in Florida, in addition I have a Masters degree in Education and have held a NYS teaching license for several years. The Florida bar as well as Florida department of education (while attending law school part time, I would like to teach in Florida) ask of sealed or expunged arrests, simply do I have to list them due to the fact that my FBI record is clear? And NYS is a state, which does not reveal sealed records expect for a pistol permit. Generally, the Supreme Court has found that states must honor the laws of other states, thus would Florida check sealed NYS arrest records? Would NYS release? And is an FBI rap sheet the same as an NCIC check?

    If you are asked about sealed or expunged records and lie, when the Bar finds out that you lied you can expect that they will either deny admission or revoke your law license. The lie itself would be a sufficient basis for that action, whether or not they would have denied membership had you told the truth.

    Very true, however it is a double-edged sword in terms of the perception of moral turpitude. Indicating yes, may not allow them to admit me, and of course if it was found out that I did not tell the truth the same may happen. However, under the full faith and credit clause of the U.S. constitution states are required to abide by the decisions of other states (hence the sealing of the arrests, which do not appear on my FBI record). New York law allows one to state that the events never happened.
