    Question What to Include in Letters Submitted in Support of a Child's Name Change

    My question involves name change laws in the State of: Texas.

    Hi everyone,

    we are sitting over the last name change documents for our minors (ages 12, 10 and 8) and we do collect other documents as well as they could be very helpful in our complicated case.

    The Counselor, Psychologist and Teachers will write a letter to the court as well as they witnessed the absolute refusal from the kid's to use their last name of their biological father who abused the children (including me) physically and emionally in the past.

    so we wonder now how should the letter look like? what should be included for sure? Any examples? The counselor and teacher want to make sure its right and will be considered.

    If this is for a contested hearing, letters aren't going to suffice. The witnesses will have to appear in court to testify.

    no, the teachers letter will be added to the forms and other documents when we request the name changes. We will also write a letter and also request for privacy (victim) protection.

    You posted previously that the father lost all visitation, but that you chose to check the box that his rights were terminated. Have you cleared that up yet? If you state that his rights are terminated when it's only his visitation that is terminated, that would be fraud.

    we interpret it as termination. We added the court documents (decision) as well. the psychologist wrote in the documents it is termination. so I am not quite sure how the court will look at it.

    he lost both custody and visitation

    You and the psychologist don't get to decide that. A court either terminated parental rights or it didn't.

    Unless the State has severed the parent-child relationship, Dad still has rights as Dad; he can still apply to the court to have his visitation/custody restored.

    My ex has no visitation or custody, his rights are not terminated. He is still legally their father and has rights to their medical records, school records, and the right to contest a name change. Termination of rights means your ex is no longer their legal father. You don't get to interpret that and a psychologist would only write what they are told, they don't look through legal documents and make the decisions. Losing visitation doesn't mean he's not their dad anymore.
