    Default Can I Get Emancipated in Oklahoma Without Special Reasons

    My question involves juvenile law in the State of: Oklahoma
    I am 16 y/o and have great grades and make $11.50 an hour at Walmart and have a lot of money in the bank. I am financially independent and feel responsible for myself. My parents do provide for me, but I want to be emancipated and they don't agree with my decision. Am I able to be emancipated without their consent given the circumstances?

    Read this.

    You are in a state that allows minors to seek emancipation for the purpose of entering into contracts. It's not about living independently. You have not indicated that you have a need to enter into binding contracts, nor would being granted such a right enable you to move out of your parents' home without their permission.

    No.

    Not going to happen.

    Keep saving your money and stick it out until you are 18.

    Then you'll know everything and can go out and face the world on your own and try to support yourself on $11.50 per hour for the rest of your life.

    Or, let your parents continue to provide for you while you go to college and then you'll be better prepared to go out and make a living.

    $11.50 is approximately $21,000 per year. Bet that sounds good while your parents are providing a place to live, educational and medical expenses, food, clothing, etc.

    I recently read an article that says a person needs to make $15 to $17 per hour to afford a half way decent apartment these days.

    My daughter was a part time grocery bagger through high school and a part time bank teller through college. She graduated in 1994 (24 years ago) and got a job with a major corporation with a starting salary of $28,000. Indexing for inflation that would probably be about $40,000 today.

    There are few if any reasons, in any state, which would cause a judge to emancipate a minor over the objections of their parents. This is most certainly NOT one of the few.

    Nor, in your state, would you be able to move out without permission even if it was.

    Okay, I didn't know that I could only sign into contracts if I got emancipated and I thank you for that piece of information. But I have one more question: Can I move out with my parents consent and not be emancipated or do I still have to be?

    You can move with your parents' consent, and that does not require you to be emancipated. Let me ask you this: what are your future plans? How are you doing in school? And WHY should your parents let move away from their supervision?

    They already denied you emancipation. They aren't going to let you move out.

    I plan on finishing school, save enough money for college until I'm 18, and getting my bachelor's degree on film production. I make an A and B average in school and take multiple AP classes. And they should let me out of their supervision because I am already working to be financially independent, and I make more than enough money to pay bills when I move out and have a little money left over to put into the bank. Those answers should answer your questions.

    Whether they "should" allow you to move out or not is immaterial, irrelevant, and a matter of opinion. The facts remain:

    IF they say you can move out, you can move out. If they say you cannot move out, then you cannot move out and there is no law you can wave under their noses that will force them to.

    Until you turn 18, your parents are legally responsible for you and your actions.

    Do you pay rent, utilities, food, car and health insurance, etc ? In addition to the things you spend your money on. If you do.not. You are not going to have enough money to pay your basic bills. . Let alone put any in the bank.
