    Question Can an HOA Be Forced to Grant Easement to Build a Dock

    My question involves real estate located in the State of: Maryland
    Our HOA owns undeveloped land declared “recreational” along a river shoreline. An adjacent property owner has requested we grant access so he can build a dock from his water view property. Another has asked for an easement so he can build a very long dock through the property. The Board decided not to grant permission to either, but can courts force the HOA to grant permission?

    I doubt it but it would depend on the wording of the HOA/CC&Rs.
