My father passed away. He was not married at the time...the only two children are my brother and I....he owns a house...........the mortgage and deed are recorded as him being the sole owner of each......He left no will. He had friends living in this house with him. These people are refusing to vacate the premises and refusing to continue the mortgage payments as they have done in the past five years for rent of the house....they actually wrote the checks for mortgage from their checking account due to the fact that my father had no checking account....and in turn this was the rental fee for each month.........when asked to leave my fathers residence after his death they stated that the house was theirs. Now the house is in foreclosure under my fathers name. How can i demand them to provide proof that my father gave them some kind of legal agreement that the house would be theirs if he died........and why wouldnt this be recorded by now..........i cant really afford an attorney and foreclosure costs if this property will not be my brothers and mine in the future.......what should i do first......im running out of time i am willing to pay for the back mortgage if i will inherit it but the mortgage company doesnt even know that my father passed away yet............
