    Red face Rent to Own

    I live in Ohio, and I rented from a rent to own company, fell behind on my payments but also did not return the merchandise.........what can they do?
    I also moved out of where I was living.

    I used to work for one of these places in their corporate office several years back. They'll do a skip trace and find out where you are living, then come and get their stuff. They've been known to have some pretty ruthless collections practices, some I've even say border on illegal. I've seen it happen even when the "renter" (thief) has moved out of state. They can sue you, get a judgment and garnish your wages. They'll pretty much bother everyone on your reference list. But why would you feel comfortable in stealing their merchandise? It's not like its yours...

    I wasn't comfortable not paying, and a lot of other issues were going on in my life and I avoided this one and thought I could get caught up on my payments, so it wasn't that I was trying not to pay, but its gotten to the point that I don't know what to do about it.

    It would really be considered stealing, not a default on a debt, I got behind and thought I could get caught up on it and didn't, alot of things have gone on in my life and I avoided this issue, just didn't know what to do about it after awhile.

    What will happen if they charge me with stealing?

    The Ohio Code indicates:
    Quote Quoting Ohio Code § 2913.72 Evidence of an intent to commit theft of rented property.
    (A) Each of the following shall be considered evidence of an intent to commit theft of rented property:
    (1) At the time of entering into the rental contract, the rentee presented the renter with identification that was materially false, fictitious, or not current with respect to name, address, place of employment, or other relevant information.

    (2) After receiving a notice demanding the return of rented property as provided in division (B) of this section, the rentee neither returned the rented property nor made arrangements acceptable with the renter to return the rented property.
    (B) To establish that a rentee has an intent to commit theft of rented property under division (A)(2) of this section, a renter may issue a notice to a rentee demanding the return of rented property. The renter shall mail the notice by certified mail, return receipt requested, to the rentee at the address the rentee gave when the rental contract was executed, or to the rentee at the last address the rentee or the rentee’s agent furnished in writing to the renter.

    (C) A demand for the return of rented property is not a prerequisite for the prosecution of a rentee for theft of rented property. The evidence specified in division (A) of this section does not constitute the only evidence that may be considered as evidence of intent to commit theft of rented property.

    (D) As used in this section:
    (1) "Renter" means a person who owns rented property.

    (2) "Rentee" means a person who pays consideration to a renter for the use of rented property.

    Why not just call the rent to own company, tell then where to find their property and give it back.

    i beleive that you out right just stole the items, if you could no longer pay for the items just return them. why piss the company off and make them come looking for you only made it worse ,in ohio and you go to jail for stealing.
