California IS a community property state, yes. I'm not sure how that applies to debts though... I do know that we can apply for credit separately in California, so I don't know how they can hold the spouse liable for that when it happens?

I figured they couldn't garnish my Dad's check, which is good to know, but it will still hurt his credit if he has a judgement on it, and I hate that! He doesn't have any other money that goes into his account, when he needs groceries or anything, I buy them for him and will continue to do so now that I know that.

I am planning on being a stay at home mom until my kids are through with school, and we have life insurance in place in case anything happens to my husband. We are nowhere near rich enough to buy a house here in California, but do rent and I know this will hinder us there too. I wish they would have agreed to a settlement, but they said that they don't settle medical bills because they are for services rendered? I think they probably could have if they wanted to, and are just being awful. They have been mean and awful every time they've called, threatening to sue me and such. I didn't know they could hold my husband liable for this though, and will have to figure out how to scrape the money together if that is the case.
You used your husbands insurance, which may be the reason he is partially responsible.
