    Question Want Roommate to Move - She's Staying for Spite

    West Virginia

    When moving here together, we decided that she would pay the rent--I would pay the utilities...it equals out. However, the landlord put the lease in my name, because we both told him it didn't matter, as I would be financially responsible for it all.

    2 weeks into this new home, and she's found 1000 things wrong--complaining about what I do or didn't do (financially), etc. Now, she's upset that her name wasn't added to the lease--when in the beginning we both told him it didn't matter.

    I told her that if she wasn't happy, she could leave. She said that she was staying just for spite. She's begun doing a lot of things for spite, especially making a lot of noise late at night when she knows I have to work in the morning.

    I told her that I would speak to the landlord about her moving. However, is it up to me to evict her, or the landlord?

    If only your name is on the lease, you can evict her.
