    Default How to Get False Charges Dropped

    My question involves criminal law for the state of: Washington state

    I was recently arrested and charged with 3rd degree mischief domestic violence. I had a complication from a medical issue that caused me to stop breathing and in the process accidentally knocked over some items totaling $85. He thought I wasn't sick so he called the cops. Sometime after I went to the doctor confirmed the diagnoses and released my medical information to another witness at the scene proving this complication was real and the damage was indeed an accident. All parties now agree this was an accident and he does not want to press charges. How do I get my case dropped?

    The so-called victim doesn't get to decide that the charges get dropped. That's up to the prosecutor.

    Have you been to court yet? What's the status of this case?

    You really should have an attorney represent you any time you are charged criminally. I have a feeling that you don't.

    No I have not been to court yet. I have a pretrial hearing in 3 weeks. I don't have an attorney, but I'm wondering if I should just get a public defender to help me dismiss this because everyone agrees it was an accident.

    The mere fact that the victim now says, "I think it was a mistake", does not of itself mean that the prosecutor will agree.

    If you qualify for a court-appointed lawyer, it would be sensible to petition for a lawyer.
