    Default Could This Be Child Porn?

    I am getting enthusiastic about photography and have a girl who has agreed to pose for me. I would eventually like to do some artistic nudes with her, probably only topless though, if she is up to it. I thought she was 17 and would be turning 18 (honestly, she looks at least 18, she was recently mistook for 25) but apparently she's 16 and will be turning 17 next week. If we did go through with this and I posted the pictures somewhere (say www.deviantart.com with an artistic nudes section) with her permission, of course, would/could this be considered child pornography since there is no explicit content?

    Yes, taking nude or sexually provoctive pic's of minors is child porn!

    In my first post I responded to your question with a LEGAL answer! It IS against the law to take nude ana sexually provocative pictures of a minor! End of story! It is considered to be child porn!
    Find an adult woman with a beautiful body, who can legally consent to these photos, for a model! Stay away from legal children...or by every state in the U.S. you will be considered a Child Pornographer!!

    There is a forum policy against promoting websites. When somebody breaks that policy the URL is removed, end of story.

    If you don't like the fact that it is a felony to take pornographic photographs of minors, to possess such photograps, or to distribute them to others, that's something to take up with your state legislature and Congress. Getting into a tizzy about how "you thought the minor was an adult" (although you knew better before taking the pictures) won't save you from prosecution. Getting upset that something that is classified as child pornography by both state and federal law is also described as such by people who respond here? That's just silly. To be upset that some people are offended by your plans? Well, what did you expect? Really.

    Note also that there are significant federal record-keeping requirements for those who take sexually explicit photographs.
