    Unhappy Collection Over Medical Bill

    Hello There,
    Any insight will be well appreciated. Husband carries medical ins. on his 2 children. He and ex are responsible for any leftover medical charges to be paid equally. Ex will not pay her half, We live in MS and she is out of state, we are not aware of any medical bills until they are in collection, up until now I have kept on top of them only thru Explanation of Benefits from the insurance co. and then to track down the doctors and call to see if there is any balance due so my husband can pay his half, and then months later get her half saying it is going to collection! I have faxed, sent divorce decree, judges order to no avail. Got a letter and bill today for $540.00 from a collection co., I imagine it is on our credit report already, she ruined husbands credit 4 yrs.ago, he worked so hard to get good(decent) standing again, seems she starting all over, questions are:
    since a collection agency has it, is it already on credit report?

    what could an atty. do to help me? other than a consultation, I can't afford much. hubby didn't have divorce atty.

    Am going to pay husbands half of debt, do I explain to CA that I never received any bills but this final one, they all went to husband's ex.she ignored them and she did not forward them to us.

    Would I be better off trying a pay for debt, and does that help on your CR?

    am going to run credit report also to check it out.

    Check with the insurance company and see what it would take for them to send you copies of the explanation of benefits reports from medical services. From a credit standpoint you're better off paying the debts and then seeking reimbursement from the ex-. However, although this depends upon the full facts and the laws of your state, you may also have the defense that it was the mother who signed as the party who agreed to cover uninsured expenses, not you, and can try asserting to the collection agency that they don't have a contractual basis to hold you responsible for the copay.
