Angry Suspected of Drug Use by Protective Services

Last week my son(he is 17) and I were unfortunately at the wrong place at the wrong time. We were at a home that was raided and several arrests were made for possession of meth. According to the report large quantities were out in the open. My son and I were not arrested. However,5 days later a DHS worker and an officer came to my own home. She said she had to follow up on a child abuse incident. Apparently they think that because I was present at the house at the time the arrests were made that I MUST have known of the drugs out in the open. I explained to the worker as well as the officers the day of the raid that I was totally unaware that there were illegal drugs present UNTIL someone had informed the individuals that the cops were approaching. At this time, an individual frantically dumped her purse contents on the floor and lo and behold there were the large quanities of drugs. She was trying to dispose of them or hide them before the cops entered the room. She was too late. So now, I face child abuse. The worker said both my son and I had to submit to drug testing. Why would they do this now if they suspected me all along? What are my rights? And my sons'? They say I could be guilty of child abuse by allowing my son to be present in this house while knowing there were illegal drugs present. How would a drug test clear me of this? Is this really necessary? Both my son and I are not worried about passing a drug test as we are not users, but this isn't my point. Can you help me understand by answering these questions? If I don't object to the drug test, wouldn't that send them a red flag? Don't know what to do. Am very stressed.

They want drug tests to confirm that you're not using, which will lend support to the position that you were "in the wrong place at the wrong time" as opposed to being there to buy or use drugs.

If you have no drugs in your system then this test should be no problem. You never said why (or I missed it) you were in a crackhouse (for lack of better word) in the first place? DHS operates in a totally different way than Police so fact you were not arreszted means little. Fact you wer ein a drug house at all is why DHS is involved.

The only reason I was in this house in the first place was I was doing a favor for the mother of the son that my son is friends with. Her machine is broken, and for the time my son was friends with her 16 year old (about 1 month) I agreed to do her laundry. I was there that day to pick up the laundry, I was only there less than 5 minutes, like that matters, like I said, wrong place, wrong time. I guess if I would have known these people were crack heads (for lack of a better word) I wouldn't have allowed myself OR my son there. You know what they say, stupidity should be painful. Thanks for your responses.

No, just the opposite - if you do object to the drug test, that would send up a red flag. (ie why are you objecting; what do you have to hide; are you/son using) Take the drug test.

oops, sorry, I meant "If I do object" won't that send a red flag. I know that it will. See, told you I was frazzled!! Thank god my husband is being supportive, and I don't associate at all with these people anymore, I even went as far as to put a block on my phone line so that they won't call me from jail. I guess I was stupid, naive, 20 years ago I trained to become a police officer, I should have seen the signs. I should have known better, I thought the woman in question was clean. She was recovering from an addiction from years ago she said. I believed her. Everyone makes mistakes I told myself and my family. If she really was my new"friend", she wouldn't of put me or my son in that situation in the first place. thank you everyone for responding.

Right, if you do object to the test, that might send up a red flag for the reasons I indicated previously. That is why we are telling you to take the test. (do not object)
