My question involves landlord-tenant law in the State of: California
I need help! I got agreement from my roommate about two weeks ago that if I found someone to replace her that she would move out. I spoke to the landlord and he is willing to take her off the lease with no penalty and would give her back her full deposit. I asked her today when she was planning to move out (she previously stopped speaking to me) and she told me today that she is not moving out. I already had another person approved and ready to move in July 1st. I know that I don't have any legal recourse to make her move out but now she has stated that since I run the air conditioner (mind you it is 101 degrees today) that she is only going to pay 1/3 of the electric and gas bill.
I get help from the company because I am in a lower income bracket but I can't afford to pay for 2/3 of the bill, my rent and my other bills. I just don't know what to do! I had prepared for her to move out and was planning to call the cost a loss but now she is digging her heels in. She won't leave and won't pay her half of utilities and I don't have a leg to stand on. She currently occupies a room, another half of a room and 5/6 of the garage with her stuff. It has been endless problems and I just want her to leave but since she is a co-tenant I can't do anything. Any help with how to get her to pay her fair share of utilities would be much appreciated. I would gladly pay for movers to get her out but she just wants to make everyone's life hell.
I work at 8 am and she comes home at 12:45 am and slams every door, drawer, and cabinet in the house. So much that our neighbors have said something. I have brought this up to her multiple times and she refuses to change. Please someone help! I don't want to be catty I just want to have a peaceful relaxing home that I feel comfortable in and it is clear she isn't going to let that happen.
