    Default Mississippi Sex Offender Registration Laws for Offenses Committed by Minors

    My question involves criminal law for the state of: Mississippi

    Good afternoon, I have a question regarding my previous conviction of sexual battery (same as statutory rape in Ms).
    In 2006 when I was 18 I was charged with sexual battery due to having a 14 year old girl friend. In 2009 I took a plea bargain and was released in 2011. Since then I have registered as a sex offender with the DMV as required and haven't been in any trouble, I occasionally search to see if Ms plans to adopt a tier system and I came across this section of the law:
    45-33-23(H)(IV) it states:
    (iv) Section 97-3-95 relating to sexual battery; however, conviction or adjudication under Section 97-3-95(1)(c) when the offender was eighteen (18) years of age or younger at the time of the alleged offense, shall not be a registrable sex offense;

    Per the law I don't have to register! I understand that I'm still a convicted sex offender but not having to register is life changing to say the least. I have worked hard since my release and have an excellent career even with the stigmatism but would greatly appreciate any legal advice or opinions on getting myself removed from the registery.

    The only thing I have to say to anyone who, as a legal adult, thought is was appropriate to have sexual contact with a 14 year old, is, talk to a lawyer. You're not going to get any sympathy here; I don't give a damn if the law says you have to register or not.

    Not looking for sympathy fella. We lived together for almost 3 years after that and I helped raise her six younger siblings during that time(both parents in prison). I have also paid for college tuition for one of them as well.
    No once did I say I made a good decision but I did my best to help this broken family. I have already set up appointments with a few local to me lawyers. I only made this post to get an idea of what I have to deal with legally in the near future. So if you have any actual advice please do share if you don't keep it to yourself.

    I'll keep it to myself since if I don't I'll likely find myself banned. I wonder if you realize how much worse you made yourself look in your second post?

    There are two issues here: The first is your conviction charge. We are not in a position to verify your conviction charge, so we cannot verify whether the charge was in fact for a violation of Mississippi Code Sec. 97-3-95(1)(c).

    Assuming that your conviction was under Sec. 97-3-95(1)(c), you would then have to investigate when the exception you note was passed into law. I suspect that you'll find that the law was changed after your conviction. If that's the case, your duty to register is based upon the law as it existed at the time of your conviction, but you may be able to have the duty modified based upon subsequent changes in the law.
