    Default Assault on a Minor by an Adult Who Broke Up a Fight

    My question involves criminal law for the state of: Kentucky My son is 17 and was taunted and told to come to the residence of a 16 yr old boy to fight. My son went to the residence beat up this boy and the boys dad picks my son up throws him not once but twice on concrete. My son has multiple injuries from being thrown by the adult not the fight. Can we press assult of a minor charges even if its on there property

    You can call the police to report it. Don't be surprised if a. they then report your son's assault on the other boy and b. he raises an affirmative defense that he was acting in self defense or defense of another. I will say self defense probably would be a hard sell based on your description of the actions taken by the dad. How do you know what the dad did? Did your son tell you?

    You also need to teach your son how to turn the other cheek, sticks and stones, etc... Violence is not the answer to words.

    Self Defense- The use of reasonable force to protect oneself or members of the family from bodily harm from the attack of an aggressor, if the defender has reason to believe he/she/they is/are in danger. Self-defense is a common defense by a person accused of assault, battery or homicide. The force used in self-defense may be sufficient for protection from apparent harm (not just an empty verbal threat) or to halt any danger from attack, but cannot be an excuse to continue the attack or use excessive force.
    The second time he allegedly picked up your son and threw him on the concrete wouldn't be considered self defense.

    Were you there? Without knowing the facts of what the 17 year old did after being thrown to the concrete the first time it's really hard to say the second was excessive. The 17 year old could still have been fighting. (Unless you were there and know way more. It's odd that a first time poster posts this after another 1st time poster posts a situiation)
