    Default Charged With Shoplifting and Child Neglect

    My question involves criminal law for the state of: Michigan. I was caught shoplifting today at a target store. It was my first time ever in trouble but they have me on camera on 2 other occasions stealing 39.99 baby formula. Today I stole about $54 in formula and children’s clothing. I was with my children so I’ve been slapped with a child neglect charge also. I was taken to jail and bailed out for $1500. My question is how likely am I to avoid jail time? I’m ok with fines and community service,I know I deserve it.i know I was wrong,money is tight. Should I hire a lawyer for this? I’m supposed to appear in court within 14business days. I am a mother of 6and I really don’t want to risk going to jail. I know I’m 100% wrong and it was so stupid.

    The odds of you going to jail are probably fairly small given the circumstances but not entirely out of the question, perhaps a weekend or 2. It just depends on the judge. While not in Michigan, I have seen judges be very displeased with parents who steal with their child present.

    If you cannot afford an attorney for the criminal charges, you should request a public defender when you appear in court.

    You can probably expect children's services to be all up in your business soon so that's probably the larger concern.

    First offense misdemeanors typically warrant probation as an alternative to jail in order to give a person the opportunity to demonstrate they have reformed. Your jurisdiction may have a diversion program that would result in charges being dropped if you attend classes, perform community service, report for supervision, etc. You will want to explore that possibility. The fact that you are a parent and were stealing baby formula is a mitigating factor. I mean, you weren't stealing jewelry, and judges certainly take into consideration whether a person is stealing necessities or luxuries. Yes, you need a lawyer. If you can't afford one, ask that a public defender be appointed. You won't get as much of a PD's time, but that is someone who can help you negotiate the best possible plea agreement. That's what you need since you won't be going to trial.
