    Default Where to Sue if You're Injured by an Out-of-State Driver

    I am a resident of Kansas who was seriously injured in a car crash in Oklahoma. The driver of the other car, "Hunter" (fake name), is a resident of Missouri. Can I demand Hunter to pay for my car repairs and personal injuries which exceed $100,000. Can I sue Hunter in federal court and if so, in which state should the lawsuit be filed?

    Sure.

    Assuming Hunter was negligent in causing the accident, of course you can. Frankly, though I think the question is rather trollish. If you have $100,000 worth of injuries you should have had a lawyer from the getgo and you wouldn't have to come here with the question.

    Your choice is where Hunter lives or the state where the accident occurred. Can't imagine why you would sue in federal court when state court would work just fine.

    What are you trying to accomplish here?

    If all parties to the lawsuit are in different states and damages are over $75,000 then you have potential to sue in federal court; but it is rare that you would choose do do in a case like this. That's a discussion to have with your personal injury lawyer.
