    Default After Tenant Gives 30 Day Notice, Can Landlord Give Notice to Move Out Sooner

    My question involves landlord-tenant law in the State of: Washington.

    hi,

    so i'm giving my 30 days notice to move out end of july. i'm on a month to month lease.
    i have always paid my rent on time, never late. and have never violated anything in the rental agreement.

    so my questions are
    1) after giving more than a 30 day notice to my landlord, can he give me notice to move out sooner?
    2) if my landlord does give me notice to move out sooner, would this be considered 'retaliation'?

    (1)(a) When premises are rented for an indefinite time, with monthly or other periodic rent reserved, such tenancy shall be construed to be a tenancy from month to month, or from period to period on which rent is payable, and shall be terminated by written notice of twenty days or more, preceding the end of any of the months or periods of tenancy, given by either party to the other.
    It is thus possible that your landlord could respond by giving you twenty days notice; but there wouldn't be much point, as if you didn't move out by the end of the twenty days it would take more than an additional ten days to get a court date, and even longer to get an order of eviction.

    Retaliation? No, there is no law that prevents a landlord from giving you the minimum required notice to end a periodic tenancy, even if you give notice first.

    thank you mr. knowitall!

    so technically, landlord can give 20 days. but with all the additional days to get a court date and legal eviction, it probably won't be worth the effort on his behalf?
    thank you for the insight. i didn't consider all the time getting an eviction from the court.

    also, the "retaliation" i was referring to was this site. i wasn't sure if this can be applied to my situation.

    The snag is that if you blow past that 20 days you'll probably receive a bad reference from a landlord which can impact your ability to rent in the future. Many LL's want references from other LL's, especially your last.

    good point. that is something to consider. i'm hoping my landlord will just accept my 30 days. and we can go our different separate ways.

    If you are expecting trouble from your landlord, and you know for sure that you will be out by the end of July, I suggest you pay your July rent on the first and then wait until July 8th or 9th to hand him written notice that you'll be out by July 31.

    If you prefer to mail him a termination letter, mail it right after the first so it gets to him by the 10th. Use tracking and delivery confirmation, but not certified as people tend to duck certified mail as bad news.

    Don't use email or texting and make sure you keep copies of your correspondence. Also make sure you photograph every inch of the place the day before you move out. If any cleaning or repairs need to be done, get them done professionally and keep receipts, no DIY half measures.
