    Angry Car Accident With Possible False Claims of Injury

    I'm 19 and I'm being sued for 2,500 by a 25 yr old woman who claims to have had injury from a car accident that occured with me a year ago.

    The car accident as follows:
    I turned into a main street from a small residential street.. it just so happened that night, the street was undergoing sobriety checkpoint. I entered the street in the middle of congestion.. as the lanes were merging, I looked to my left and I hit the car in front of me (the owner of the car, the woman suing me, was passenger). Of course, I didn't hit them any harder than 5mph.. considering it was a checkpoint and the street was backed up for about a mile.

    Anyhow, they reported it to the police since they were already there.. and they claim that I cracked their bumper on the side (I hit them directly behind).. My insurance paid for the bumper.

    Late last year she's been trying to get my insurance to pay for $2,500 in medical bills for injury "caused" by the damages.

    My insurance wants to fight and so do I.

    Is their a possibility that I could lose the fight.. even though I only hit her under 5mph?

    I am no longer currently insured by the same insurance from the accident.. but will they pay for it if I lose (I had full coverage)?

    The damage on the car only suffered cosmetic damage.. the crack on the bumper. Nothing was done to the frame or any other part of the car. My car suffered no damage whatsoever.. not even a scratch.

    I'm also very skeptical about the crack on the bumper.. however thats not the case.

    A: Probably.

    The company who insured you at the time of the accident should cover you as the result of any accident you were in during the time they insured you.

    There is always a chance you could lose at trial, (IF the case ever even gets to trial) for several reasons, the Plaintiff (her) is deemed to be "more credible" than the defendant (you), sympathetic jury (it's only $2500), medical evidence that there is some sort of whiplash injury. But if your ins co wants to fight it, they will be incurring the costs of litigation.
