    Default Probation Violation Help

    I am on 10 years deffered adjudication probation for a theft charge. I've been on probation for about 3 years. There was a warrant released for probation violation because I failed to report last month due to I had traffic warrants that I had to clear up and was scared that I was going to get taken in if I reported while having those active warrants. I'm working and about to enroll in school again(college). I'm just worried what will happen. Will the courts take this to be extreme???What would be involved?(jail time/work release/more probation/community service???)

    If you're lucky, you can convince the probation officer and court that it was a one-time mistake, and will be permitted to continue your present probation. If you continue to fail to show up for probation or court, you'll likely be resentenced on the original charge.

    You should consider consulting a local criminal defense lawyer.

    If you are discharged as a violator and resentenced on the original charge, that's a possibility (less any time served). Of course, that's a "worst case scenario", not likely to happen from missing one appointment - but increasingly likely if you continue to miss meetings and court dates.

    Don't they usually plea bargain in these cases before it is presented to a judge in a trial setting? I've been doing some research and it is a "technical" violation" that usually is not that extreme. They have to take into consideration that I'm working, paying my fines, completed my community service, going to school, no trouble in 3 yrs, etc.

    You need to find out what your probation officer is recommending, either directly or through a lawyer.
