    Default Divorce and Bankruptcy

    I'm recently divorced. My ex wife is filing for bankruptcy. While married, almost all of the credit cards were in her maiden name. None of the debt is showing up on my credit report. If she files for bankruptcy will they come after me for the debt? If it is in her maiden name how will they know who to go after?

    If they investigate and find that you were using the cards, or that your wife made a series of purchases for your benefit which ran up her debt in advance of the bankruptcy, they may seek to have portions of the debt excluded from the discharge. They might seek to compel you to restore certain assets to your wife's bankruptcy estate. But beyond that, they would not have any direct ability to sue you for her debts, as they have no contractual relationship with you in relation to the debts.
