Default Re: Green Card Renewal After Arrested for Assault

Arrests mean nothing. CONVICTIONS very much could result in your residency being terminated and you being deported. "Assualt" isn't detailed enough to tell. There is a list of crime categories that can result in your deportation.

So, it depends on details not presented here.

    1. If you have a conviction, you need to talk to an immigration lawyer NOW, to see if you are facing deportation and what can be done. Aggravated felonies and DV convictions can get you deported, as can anything described as a sex or drug crime or involves firearms.
    2. If you have the assault charge pending, you need a lawyer immediately to handle that. Let him know about your green card status and that a conviction of certain classes will risk deportation.
    3. If only arrested and released without charges or the charges were dismissed, it won't affect the application now, but you may wish to research an attorney in case they can be filed later.
