    Default National Driver Register, Limitations

    I have been without a license for over 10 years but am finally in a position where I might afford to reinstate. My issue is that I have suspensions/revocation on NY and AL driver licenses.

    I made the mistake of getting a new license in AL in 1988 while in college instead of reinstating my NY license and surrendering to get my AL license. I then went on to get traffic violations against the AL license which led to the suspension. I often did not pay tickets or appear for summons as I was irresponsible and was often too broke to pay any fines.

    When I returned to NY after college (1991) I realized it would be simpler to reinstate my NY license than deal with the AL, which I did. I maintained that license for the most part but eventually it was suspended for failure to appear on summons which I could not afford to pay.

    I have sought legal advice on how to deal with these issues and reinstate or otherwise obtain a hardship license. One attorney actually urged me simply to obtain a new license in a different state, which of course failed because of the NDR search.

    Another attorney advised I reinstate my NY license as it would be simpler than deal with both, but I suspect that in the process an NDR search would be done and I would still be forced to deal with the AL license.

    What I expect is that the only true way to rectify this mess is to deal with all the issues, at least one of which requires a court appearance because a bench warrant was issued for failure to appear. I would point out none of my violations were for anything more severe than speeding, no DUIs or anything criminal such as leaving the scene of an accident.

    Many of these violations are very old (some almost 20 years) and I suspect some difficulty in discharging some of the very old items as records may have been purged.

    Apart from general advice, I am wondering how and when any statute of limitations would apply.

    The statutes of limitation have nothing to do with your situation. They stopped running the day you were charged.

    In any event, the bottom line is that you will have to get this mess straightened up in both states.

    Thanks for the helpful, if brief, response. Any way I can have a request to appear handled locally by an attorney?

    I am thinking specifically of a DWLS on the AL license from 1989. My last attorney said I would have to go down there and appear. Would it be possible to have a local attorney handle this so I could avoid the time and expense of travelling halfway across the country? It is this sort of thing that has been a barrier for me dealing with this stuf until now.

    I would be happy to answer your questions but no one gives a rip what I think.

    What you need to do is hire a lawyer and have that lawyer try to work things out.

    Money (to pay for your sins) and a lawyer often solve a lot of problems.

    I am a little confused by your statement, but I get what yo uare saying.

    I suspect I can handle the majority of the local items myself (I have everything organized and documented, so at this point it is largely a matter of money), but it is this one situation which I have been told requires an appearance for DWLS and a subsequent failure to appear.

    It seems to me what would make the mmost sense would be to find a local attorney and have him handle that one item; otherwise the alternative is to simply make the appearance. My concern is: if I made arrangements and showed up, could I be facing jail time, especially if they determine a fine which I could not pay on the spot?

    I realize these might seem like foolish questions; honestly I am just trying to "pay for my sins" as you say, but sometimes when you don't even have the funds to pay a modest fine it can seem pointless to try and do anything about it.

    Just wanted to thank the moderators for their advice. After many letters, calls and payments, yesterday I was able to get my CT license.
