    Default Roomate Breaches Contract, Refuses to Pay Me Back

    Hello everyone, Please hear me out this is of urgent matter.

    Here is my problem. I live in Miami, FL and I lived in an apartment where my father had a verbal agreement with my roomate to which they agreed upon the rental price and the move-in date.

    I lived there for almost 9 months when last week I received a message from her telling me that her rent was going up because of me? I immediately asked for explanation but she told me that I now owed her $1050 (difference of rent until her lease contract expires). I disagreed with her and told her numerous times when she called me to call my father and talk to him as she made the agreement with him. Apparently the problem was that the landlord cashed the rent check from her before my check cleared in her account (There was no due date set forth in the verbal agreement, all that was mentioned was the "beginning of each month").

    She refused to talk to my father so I made my father come down here and talk to her, they disagreed on the fees that she was trying to charge me after I paid the monthly rent. She called the cops on my dad but they did not do anything as it was a civil matter. That same day, my father told her "Okay, we move out on the 15th and you give back half the rent". She Said "okay".

    Today (The 15th) I called the apartment since I moved out earlier than scheduled and she was very rude. I asked her if she would pay me the money we agreed to, she said "NO? Do you have MY money?". I am done trying and would like to pursue her in court. There was absolutely no written agreement where I had a specific due date and she tried to charge me after I paid the monthly rent. She is refusing to pay me half the rent since I moved out halfway through the month as we both agreed. I called the local police department's non emergency line where I was told that this breach of contract can be taken to small claims court.

    Any idea from you guys? Oh and she wanted me to move out the next day (12th) without giving me a 30-day notice. What can I do? I had to pay for a moving truck rental, and the storage for a month.

    You can take it to small claims court, and try to get the judge to undertand what happened. My guess is that your former roommate is going to tell a very different story than you have told.

    Aaron, the thing is that I did watch my back.

    I returned the keys and got a receipt from the landlord's office directly for that. I sent her a certified mail letter requesting my rent money back. I have printed copies of the check she cashed in for the rent's money. And I have 2 witnesses who were there when she agreed to pay me back half my rent money.
