    Default DUI in Tennessee

    my husband was charged and sentenced 11/29 for 3 rd dui ,evading aresst ,and durg pare for rolling papers. his lawyer did the talking to the d.a. and told him this was the best he could do. he was given his time at the work house. his lawyer also told him not to pay the fines at that time that he would not have to pay them most likely. but come to find out that was wrong he still pays them plus 20 dollars a day for been in. he has almost served 120 days the man. but one of the other inmates had more serious convictions only had 120 days and told him he needs to write the judge for a suspened sentence. ive tried to contact his lawyer but it seems that a little over a couple of months ago he joined the d.a.s office and is not able to be contacted. so is it possiable to get a suspened sentence or even parole for him? his business is going under cause i can't do it myself, any sugestions?

    Let's start at the top.

    Was he sentenced for a felony?

    If so, for how long?

    Why (after being given so many chances) would any judge want to let him out on probation?


    Answer those three questions.

    no he was'nt charged with a felony, the only thing he got charged for was dui and suspended lis. the rest was dropped. he was given a 11/29 at the workhouse which after 120 days are served then his time for time would start, which would make his time go down to 8 months top. and as far as his chances, yes he has but since he has meet me( the dui happened before we meet) he has chaged his life, he has a business that im tring to keep going, he has been a model inmate, he has worked double shifts for them and got any credit, he has learned a vaulable lesson, my life is completely different than what hes use to be----with me he has been reborn. well i hope that answered them all.

    Okay, I still don't understand.

    How long was his sentence?

    When is he getting out?


    (By the way, "He behaves himself in prison" is not going to impress a judge.)

    it was 11months 29 days as of right now it would probally be last of sept or the frist of oct. the reason im asking is i think hes lawyer sold him out to get in with the DA'S office, another guy in there had his 5th dui and jumped bail went to fl. but the 11/29 was he sentence if he stays till sept or oct he will flaten out

    Sounds like he is right where he belongs.

    Based on what you say, I wouldn't want him on the streets!
