    Question Young and Dumb - Is Bankruptcy For Me?

    Ok well im 22 and live in California. When i was 18yrs old i got a job tat seemed 2 b going well. i was making good money. I was the so-called "Secretary" of the corp, but the way they were paying me was w/the corps. credit cards! I decided to apply for supply credit cards for a division of the corp. The man incharge stated to us tat corporate credit cannot effect ur personal credit. i dont really know if tat is true because b 4 i quit my co-worker let me know tat she had been talking 2 people n found out tat was a lie. After 7 of us quit and found out this whole corp. was Bull S***!!!!! I went on w/ my life n got an ordinary job. i was'nt making the same $ of course, my payments really fell behind n I got 2 a point were i just stop paying. to top it off that stupid corp. reported tat i made $56,000 the year i worked 4 them . which is a lie but now i owe the irs n state besides my creditors. my accounts r now in collections or in process of being there. im making some payments to some of the accounts tat r in collections. My total debt is about $32,000-$43,000 including the corp. cards n irs debt which is $8,470. Lately ive been thinking a lot about going bankrupt with my new born son i think about the future n just the thought of my wages being garnish really upsets me because i want 2 make money 4 me n my son not for creditors. im a single mom now since his father is in jail! Well tats my story n my questions are ....

    Can i bankrupt the irs debt n the corp. cards w/my personal debts?

    I'm the co-signer for my moms mobile home can the bankruptcy have an effect on her house? do i have to include the mobile home?

    Can utility bills be included in my bankruptcy?

    Do you think i can qualify for bankruptcy?

    Sorry so many people have been 'lying' to you.

    Under certain circumstances, IRS taxes can be included in the bk, but they have to be at least 3 years old and there are some pretty particular circumstances that have to be met - best if you consult a tax attorney or do a good bit more research. From what you've shared, most of the unsecured credit can be included, but there's a good bit more to learn. Do some research and get a few free bk consultations first.

    I agree. You need a bankruptcy attorney to whom you can ask all your questions & help you decide if bk would be the best way for you to go.

    I do not understand. If the employer says they paid you 56k, but your records show 25k--then you can prove you are right. The IRS will believe you because the employer has no proof, especially if they have vanished. Also, are you saying that you used your personal credit card to charge goods that were used by the company? If so, these amounts can offset the pay received to arrive at your net pay. Before filing BK, talk to several BK attorneys, read some books, and go visit BK court to find out how it works. It is not simple.
