    Can a hotel guest gain rights as a tenant? If so, how does that occur?

    In a regular hotel setting, with a room rented by the night, a hotel guest does not become a tenant. There is a possibility of a state law that creates rights in a tenant who has been in residence for a particularly long stay, but no hotel guest should anticipate that a lengthy stay will transform their stay into a tenancy.

    At the same time, some hotels hold themselves out as long-term stay hotels, perhaps charging rent by the week or the month. Such a hotel can cross a line from having hotel guests to having tenants, or may be subject to additional restrictions on eviction even if their long-term guests are not technically tenants.

    The long and the short of it is, it will depend upon the full facts, and the law of the state in which the hotel is situated.
