    Default What Should a Tenant Expect at a Forcible Entry Eviction Hearing

    An Ohio woman lived with her elderly mother, who was the tenant on a month-to-month lease. Her mother passed away, and she is now a month behind on rent.

    She does not want to stay, but the home is full of her parents' belongings. She has not yet found a new home.

    Her court date on the eviction case is tomorrow. What should she expect to happen in court?

    If she is not fighting the eviction, the court is likely to order the eviction and give the tenant between seven and ten days to move out. She may be able to get a brief adjournment by telling the court that she needs time to seek an attorney, but she can't count on being granted an adjournment.

    If the tenant has not vacated by the end of that period, the landlord may have the tenant forcibly evicted by the Sheriff's department, and all of the property will be moved out of the home.

    The tenant should look for a home as quickly as possible, or consider trying to pay her rent and convince her landlord to let her stay longer. In the alternative, she can consider moving the property into storage so that it won't be lost or destroyed as a result of the eviction; although she would still need to find a place to live.
