    Default Can an Adult Take a Minor Child That is Not His Out of State Against Parents Wishes

    My question involves civil rights in the State of: Iowa. My son still goes to my ex’s house (who is not my sons father) with his brother I have suspicions that he is planning to take both of my sons out of state even though I have not given permission for the son that is mine not his. If he does take him out of state, what can happen to him?

    Unless the travel is for something illegal and you have given your ex permission to be with your sone no crime has been committed.

    My question to you is if you have the concerns why do you allow your son to visit your ex?

    If your ex has no court-ordered custody or visitation rights, removing the child from the state can constitute criminal parental interference....

    Given that there is a history of allowing visitation, I doubt a prosecutor would bother with such charges so long as the child is returned. It could happen but I'd put the odds less than 50-50.

    Mom needs to talk to the ex about the potential plans. If she knows a trip out of state is occurring and doesn't wish for her other son to participate, she should not send the other son for that particular visit. Maybe discuss whatever reasons she has for not wanting the other son to go with the ex and see if any kind of compromise could be had.
